Class-action lawsuit in plant-based milk recall settled at $6.5M

TORONTO — Canadians who bought or drank recalled plant-based milk linked to a listeria outbreak have reached a $6.5-million settlement with Danone Canada, Wal-Mart Canada Corp., and Intact Insurance Company.

The settlement is tied to a listeria outbreak that led to a national recall of several Silk and Great Value plant-based milk products in July 2024.

The Public Health Agency of Canada said 20 illnesses were reported and three people died in the outbreak.

The Superior Court of Quebec authorized the class action on Nov. 17, subject to settlement approval hearing in Montreal on Jan. 26, 2026.

Lawyer Joey Zukran, who is representing the class, says it’s too soon to determine how many people will take part but compensation will be distributed based on the severity of illness after drinking the recalled plant-based milks.

That ranges from $400 for claimants who experienced symptoms for up to 48 hours, to $150,000 for those who developed severe complications.

If approved, the settlement will end similar proceedings in British Columbia.

Danone Canada’s head of communications says the company “remains actively engaged in the legal proceedings to achieve a timely and appropriate resolution for its consumers.”
