A 26-year-old man was sentenced today to 55 days in jail for a September, 2011 robbery in Penticton.

Instead of taking the advice of Devon Spletter's lawyer, Penticton Provincial Court judge Anne Wallace decided earlier today, actual jail time would be better than a conditional sentence served at home.

Wallace spoke about Spletter's legal troubles with previous assault charges and at least one probation violation. She said a conditional sentence or probation would not be enough of a deterrent for him. It's Spletter's fourth conviction for a crime involving violence.

While he is incarcerated Spletter will write a letter of apology to his robbery victim. He will also spend two years on probation, be banned from owning a firearm for life. Finally, he was ordered to get help for a brain injury after having suffered two assaults himself in the past and from being involved in two car accidents.
