High speed flight and breaches result in jail term

PENTICTON – A Penticton man will serve a six-month jail sentence for breaching conditions and several driving misdeeds.

Jesse Kane Armstrong appeared in Penticton court by video today, July 4, to hear his sentence after entering guilty pleas to three counts of breaching release conditions, dangerous operation of a motor vehicle, driving while under a suspended license, and possession of stolen property under $5,000.

Crown Prosecutor Vern Frolick told court police attended Armstrong’s residence on May 3, 2016, expecting to find him inside his residence. Instead, they found him on the roof.

Armstrong was found in a fetal position, in possession of a knife.

He told police he had broken up with his girlfriend and was eventually talked into coming down from the roof.

Police found another knife in Armstrong’s pocket. He said the knives were for protection from bears.

He was charged with breach for failing to remain in his residence.

In a second incident, police investigated a break and enter at a seasonal residence and found evidence of a vehicle driven onto the property that displayed plates later identified as stolen.

The following day, police identified the vehicle on the property where Armstrong was residing.

When he spotted the police, Armstrong got into the vehicle and drove off at a high rate of speed, accelerating through stop signs at two Penticton intersections. Police did not pursue the stolen vehicle, later finding it at a Tim Horton’s.

They arrested Armstrong a short time later. At the time of his arrest, Armstrong was also under a driving prohibition.

Frolick and defence lawyer Robert Maxwell submitted a joint submission to Judge Gale Sinclair, requesting a six month jail term for the numerous counts.

One year’s probation, a $500 fine for driving while prohibited, and a two year driving prohibition, were also part of the submission, to which the judge agreed.

With time served, the 27 year old man has another 109 days left in his sentence.
