Civil lawsuit can proceed in disabled man’s death
BALTIMORE – A federal judge says a civil lawsuit can go forward against three Maryland sheriff’s deputies involved in the asphyxiation death of a man with Down Syndrome.
The Washington Post reports (goo.gl/ifVBHj) U.S. District Judge William M. Nickerson ruled Friday that a jury should decide whether the Frederick County deputies’ actions led to Robert Ethan Saylor’s death.
Saylor died of asphyxiation in 2013 after he had watched a movie with his caregiver and went back into the Frederick theatre for a repeat showing without paying.
He suffocated after the deputies, who were moonlighting as mall security guards, tried to forcibly remove him from the theatre. The deputies were cleared of wrongdoing by an internal affairs investigation and were not charged with any criminal offences.
A trial date has not been set.
