{"id":4863,"date":"2025-09-01T06:00:00","date_gmt":"2025-09-01T13:00:00","guid":{"rendered":"https:\/\/staging.infonews.ca\/?p=7333602"},"modified":"2025-09-01T06:00:00","modified_gmt":"2025-09-01T13:00:00","slug":"penticton-man-sues-after-icbc-calls-lasting-concussion-a-minor-injury","status":"publish","type":"post","link":"https:\/\/staging.infonews.ca\/inwheels\/news\/4863\/penticton-man-sues-after-icbc-calls-lasting-concussion-a-minor-injury\/","title":{"rendered":"Penticton man sues after ICBC calls lasting concussion a &#8216;minor injury&#8217;"},"content":{"rendered":"\n<p>A South Okanagan man who was rear-ended four years ago has had to resort to taking legal action against ICBC after it refused to accept that the crash had caused him significant cognitive issues and he&#8217;d had to largely give up work.<\/p>\n\n\n\n<p>According to an Aug. 28 BC Civil Resolution Tribunal decision, the crash caused Glenn Morezewich to work a fraction of what he had done after he found himself &#8220;living in a haze.&#8221;<\/p>\n\n\n\n<p>The decision said Morezewich, who works practicing Chinese medicine, could only handle two repeat clients &#8220;on a good day.&#8221;<\/p>\n\n\n\n<p>He complained the concussion he sustained during the crash meant he struggled to schedule, meet with, interview and treat patients.<\/p>\n\n\n\n<p>However, ICBC classified his injury as &#8220;minor&#8221; subjecting him to a $5,500 cap for pain and suffering.<\/p>\n\n\n\n<p>The &#8220;Minor Injury&#8221; legislation was brought in in 2019 and has criteria that ICBC classifies as &#8220;minor.&#8221; Anyone unhappy with ICBC&#8217;s decision has to then challenge it at the Civil Resolution Tribunal.<\/p>\n\n\n\n<p>So far this year, 26 people have taken ICBC to the Tribunal with about a 60% success rate in proving their injuries aren&#8217;t minor.<\/p>\n\n\n\n<p>In Morezewich&#8217;s case, he said he was left with difficulty focusing and lowered energy following the crash. He said his injury was far from minor and he&#8217;d been left with lasting cognitive difficulties.<\/p>\n\n\n\n<p>His doctor found he had decreased memory and excessive sleep after the assault, along with irritability, mood swings, decreased tolerance of stress, vision issues, balance issues and headaches.<\/p>\n\n\n\n<p>&#8220;He was unable to &#8216;shift gears&#8217; between tasks, and had to take breaks throughout the day,&#8221; the decision read.<\/p>\n\n\n\n<p>The decision said three months before the crash, Morezewich was assaulted and left with a concussion and he still had not returned to work when he was rear-ended.<\/p>\n\n\n\n<p>ICBC argued that as he was not working at the time of the crash and as he needed to be in &#8220;continuing&#8221; work, he wasn&#8217;t covered.<\/p>\n\n\n\n<p>However, the Tribunal wasn&#8217;t swayed.<\/p>\n\n\n\n<p>&#8220;He was practicing Chinese medicine less than six months before the accident, and evidence shows he returned to practicing Chinese medicine, albeit for fewer hours, as his recovery progressed,&#8221; the Tribunal said. &#8220;While there may be cases in which such a lengthy period of time has passed between employment and an accident that it stretches the word &#8216;regular&#8217; to its breaking point, that is not the case here.&#8221;<\/p>\n\n\n\n<p>Morezewich submitted several psychological reports that gave an extensive diagnosis of his cognitive issues since being rear-ended.<\/p>\n\n\n\n<p>While Morezewich had suffered earlier concussions, one doctor said his symptoms were consistent with the accident and likely permanent.<\/p>\n\n\n\n<p>One report stated his cognitive difficulties were consistent with his history of concussions&nbsp;and it would be unlikely for him to return to being fully functional.<\/p>\n\n\n\n<p>&#8220;I find the descriptions of (Morezewich&#8217;s) symptoms throughout the medical evidence are consistent with a substantial inability to perform the essential tasks of his regular employment,&#8221; the Tribunal ruled.<\/p>\n\n\n\n<p>The Tribunal also noted that neither of his doctors was concerned that he was exaggerating or misstating his symptoms.<\/p>\n\n\n\n<p>Ultimately, the Tribunal ruled ICBC not to classify his health conditions as &#8220;minor injuries&#8221; and ordered the insurance to cover $5,000 of his $8,000 legal bill.<\/p>\n\n\n\n<p>The decision didn&#8217;t give any indication of what benefits Morezewich will get now ICBC can&#8217;t call his concussion a &#8220;minor injury.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The insurer also argued as he was off work at the time of the accident so he wasn&#8217;t covered.<\/p>\n","protected":false},"author":292,"featured_media":4864,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"guid":"","source":"","byline":"","published":"","updated":"","_infotelid":"","_prepressid":"","_multisite_post_sync":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[1285,492,493],"tags":[],"region":[206,207,208,209],"class_list":["post-4863","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-featured","category-local","category-topnews","region-kamloops","region-kelowna","region-penticton","region-vernon"],"blocksy_meta":[],"jetpack_featured_media_url":"https:\/\/staging.infonews.ca\/inwheels\/wp-content\/uploads\/sites\/5\/inwheels-hd-mediaitemid70143-1351.jpg","post_modified":"2025-09-01T06:00:00","post_modified_gmt":"2025-09-01T13:00:00","jetpack_sharing_enabled":true,"_links":{"self":[{"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/posts\/4863","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/users\/292"}],"replies":[{"embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/comments?post=4863"}],"version-history":[{"count":0,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/posts\/4863\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/media\/4864"}],"wp:attachment":[{"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/media?parent=4863"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/categories?post=4863"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/tags?post=4863"},{"taxonomy":"region","embeddable":true,"href":"https:\/\/staging.infonews.ca\/inwheels\/wp-json\/wp\/v2\/region?post=4863"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
